Domino's steps up case against IT firm
A court case between Domino's Pizza and Sydney IT company Precision Tracking has been adjourned until 2018 after the pizza chain added new claims related to an alleged breach of confidentiality.
SYDNEY - [AAP] A court case between Domino's Pizza (ASX: DMP) and Sydney IT company Precision Tracking has been adjourned until 2018 after the pizza chain added new claims related to an alleged breach of confidentiality.
Precision Tracking is involved in a dispute with Domino's over the rights to technology used in the pizza maker's GPS driver tracker.
Precision Tracking claims it developed the technology behind Domino's driver tracker before the pizza maker ended the pair's relationship and signed with rival company, Navman Wireless.
The court case began in 2016 when Domino's challenged Precision Tracking's ownership and validity of patents, and alleged threats of patent infringement and misleading and deceptive conduct against the IT company and its directors.
Precision Tracking defended the validity of its patents and countersued Domino's and Navman Wireless for patent infringement, breach of confidential information and copyright infringement.
Domino's on Tuesday successfully applied for leave from the Federal Court to amend its case to allege that information including the performance benefits of Precision Tracking's GPS system was confidential, and wrongfully used by the IT company.
The court adjourned the hearing and it is now not expected to be held before July.
Precision Tracking said in a statement that it will continue its case and answer the new allegations.
Domino's denies all claims made by Precision Tracing and says it is vigorously defending the proceedings brought by the IT company.
In 2015, Domino's announced it would use Navman Wireless as a preferred supplier due to its technical abilities, usability and price and said it was "no way based on, or uses," the Precision Tracking technology.
